These General Conditions of sale are valid as of 06/30/2017 and refer to the products purchased at the time when these conditions were available, remaining then in force in everything that in the same be available until they are notified of their modification or update.

These conditions refer to the reservation, purchase and provision of packages tourist FLYKUBE.

The person who acquires the service through the page has the consideration of Client website www.flykube.com , assuming that the Client may or may not be the Beneficiary of the benefit, depending on whether it makes personal use of the integrated tourism package or that I buy it to give to a third party.

The Customer who purchases through the website must be of legal age (at least 18 years) and have the legal capacity to acquire the services and / or products offered through of www.flykube.com stating that you understand and understand the general conditions in your whole.

NEW WORLD SOLUTIONS, S.L. reserves the right to make without prior notice the changes it deems appropriate, both on the web and in these conditions general. Changes that affect the essential elements of the conditions of contracting will not be applicable to the contracts already stipulated, unless the client express form accept the modifications introduced.

DEFINITIONS

FlyKube: integrated tour package, consisting of round-trip flights and the Accommodation with a random destination depending on the product namely:

  • -Surprise destination: The user chooses the dates of the trip but the destination is random (chosen by NEW WORLD SOLUTIONS, S.L., subject to availability and operated by a third air operator and other collaborators). When acquiring a Flykube, the Beneficiary is waiting for confirmation of package availability selected.
  • -Weekend surprise: the user chooses the destination to which he wants to travel but not the dates on which you will travel. The user can choose if he prefers a trip from Friday to Sunday or from Saturday to Monday, the trip will be made during the following 12 week (chosen by NEW WORLD SOLUTIONS, S.L., subject to availability and operated by a third-party air operator and other collaborators). When acquiring a Flykube, the Beneficiary is waiting for confirmation of availability of the selected package.
  • -All surprise: the user will not choose the destination or the dates of the trip, ALL tourist services will be chosen at random by the company NEW WORLD SOLUTIONS, S.L.

Operator: Designates the borrower selected by NEW WORLD SOLUTIONS, S.L who provides the provision of air transport services to the Beneficiary.

Contributor: Designates the borrower selected by NEW WORLD SOLUTIONS, S.L who provides the provision of accommodation services and / or other tourist services to Beneficiary.

Beneficiary: Designates the user of the FlyKube trip.

Part (s): Designates NEW WORLD SOLUTIONS, S.L and the Client.

Web: Designate www.flykube.com

FIRST: REQUEST FOR THE ORDER AND FORMALIZATION OF THE CONTRACT

The Client can request their FlyKube orders through the Web. In particular, the Ordering process through the Web involves the following steps depending on the chosen service, namely:

Surprise destination:

  • a. The customer will select the type of service "Surprise destination" on the web www.flykube.com
  • b. The Client will select the city of origin in the drop-down menu within the web www.flykube.com/planner/destination.
  • c. The Client will select on the Web the number of Beneficiaries that will use the FlyKube.
  • d. The Client will select on the Web the time restrictions, in reference to if the Client wants to travel from Friday to Sunday or from Saturday to Monday.
  • e. Once the number of travelers has been selected, the city of origin and the time preferences, the Client will select the dates of the package in the who wants to enjoy FlyKube The packages are composed of three (3) days. The departure flight departure time may vary between 06:00 and 23: 59h of the first day of the package. The departure time of the return flight can to oscillate between 06:00 and 23: 59h on the last day of the package.
  • f. Once the dates are chosen, the Client can choose the time slots of departure of the flight and return of the flight. There are 3 slots, which are can restrict according to user preferences (restrictions will lead to an increase in the price).
  • g. If possible, and according to availability, NEW WORLD SOLUTIONS may contact the Customer (once the reservation) to suggest alternative flights outside these hours.
  • h. The Client displays the list of destinations to which he could travel. The client you can 'delete' a destination (discarding it from possible destinations) free.
  • i. The Client can also 'delete' additional destinations for € 5 per city and passenger. There is a maximum of 9 destination restrictions.
  • j. By continuing with the process the Client will access the process section where you must enter the data of the Beneficiaries. The Client is responsible for the veracity of them. NEW WORLD SOLUTIONS no is responsible for possible denials of boarding or other cases derived from errors in the data of the Beneficiaries.
  • k. By accepting and continuing the process of purchasing the FlyKube services, the Customer will enter the payment and billing information.
  • l. By accepting and continuing the process of purchasing the FlyKube services, the order will be registered, subject to having expressly accepted the present General Conditions of sale.
  • m. A message confirming receipt of the order and the Purchase process will be finished.
  • n. After the final validation of the order by NEW WORLD SOLUTIONS, S.L, The Customer will receive an email confirming your order recapitulating the set of elements related to it. Only printing and / or keeping this email, the Client will have a means of proof of your order.
  • o. In a period of 96h to 36h before the completion of the combined trip, the confirm to the Client via e-mail and / or through the section "my reservation" in the website www.flykube.com to which of the possible destinations will travel the Beneficiaries, as well as the details of the flights, instructions to carry out check-in (if necessary) and information about the accommodation.

Surprise weekend:

  • a. The client will select the type of service "Surprise weekend" on the web www.flykube.com
  • b. The Client will select the city of origin in the drop-down menu within the web www.flykube.com/planner/dates.
  • c. The Client will select on the Web the number of Beneficiaries that will use the FlyKube.
  • d. The Client will select on the Web the time restrictions, in reference to if the Client wants to travel from Friday to Sunday or from Saturday to Monday.
  • e. Once the number of travelers has been selected, the city of origin and the time preferences, the Customer will select the destination of the package that wants to enjoy with FlyKube. The packages are composed of three (3) days. The Departure flight departure time may vary between 06:00 and 23: 59 of the first day of the package. The departure time of the return flight can to oscillate between 06:00 and 23: 59h on the last day of the package.
  • f. The Client will visualize a calendar with all possible weekends in which I could travel. The Client can 'eliminate' a weekend (discarding the possible travel dates) for free.
  • g. The Client can also 'delete' additional destinations for € 5 per city and passenger. There is a maximum of 9 weekend restrictions.
  • h. Once the destination and date restrictions have been chosen, the Customer can choose the flight departure and return flight slots. There are 3 stripes hours, which can be restricted according to the user's preferences (The restrictions will lead to an increase in the price).
  • i. If possible, and according to availability, NEW WORLD SOLUTIONS may contact the Customer (once the reservation) to suggest alternative flights outside these hours.
  • j. By continuing with the process the Client will access the process section where you must enter the data of the Beneficiaries. The Client is responsible for the veracity of them. NEW WORLD SOLUTIONS no is responsible for possible denials of boarding or other cases derived from errors in the data of the Beneficiaries.
  • k. By accepting and continuing the process of purchasing the FlyKube services, the Customer will enter the payment and billing information.
  • l. By accepting and continuing the process of purchasing the FlyKube services, the order will be registered, subject to having expressly accepted the present General Conditions of sale.
  • m. A message confirming receipt of the order and the Purchase process will be finished.
  • n. After the final validation of the order by NEW WORLD SOLUTIONS, S.L, The Customer will receive an email confirming your order recapitulating the set of elements related to it. Only printing and / or keeping this email, the Client will have a means of proof of your order.
  • or. In a period of 168h to 96h prior to the completion of the package trip, confirm to the Client via e-mail and / or through the section "my reservation" in the website www.flykube.com on which of the possible weekends Beneficiaries will travel, as well as flight details, instructions to check-in (if necessary) and information about the accommodation.

All surprise:

  • a. The customer will select the type of service "All Surprise" on the web www.flykube.com
  • b. The Client will select the city of origin in the drop-down menu within the web www.flykube.com/planner/surprise.
  • c. The Client will select on the Web the number of Beneficiaries that will use the FlyKube.
  • d. The Client will select on the Web the time restrictions, in reference to if the Client wants to travel from Friday to Sunday or from Saturday to Monday.
  • e. The packages are composed of three (3) days. The flight takeoff time of The trip may vary between 06:00 and 23:59 on the first day of the package. The takeoff time of the return flight can vary between 06:00 and 23: 59h of the last day of the package.
  • f. The Customer can choose the departure and return flight time slots of the flight. There are 3 time slots, which can be restricted according to the user preferences (the restrictions will lead to an increase in the price).
  • g. If possible, and according to availability, NEW WORLD SOLUTIONS may contact the Customer (once the reservation) to suggest alternative flights outside these hours.
  • h. By continuing with the process the Client will access the process section where you must enter the data of the Beneficiaries. The Client is responsible for the veracity of them. NEW WORLD SOLUTIONS no is responsible for possible denials of boarding or other cases derived from errors in the data of the Beneficiaries.
  • i. By accepting and continuing the process of purchasing the FlyKube services, the Customer will enter the payment and billing information.
  • j. By accepting and continuing the process of purchasing the FlyKube services, the order will be registered, subject to having expressly accepted the present General Conditions of sale.
  • k. A message confirming receipt of the order and the Purchase process will be finished.
  • l. After the final validation of the order by NEW WORLD SOLUTIONS, S.L, The Customer will receive an email confirming your order recapitulating the set of elements related to it. Only printing and / or keeping this email, the Client will have a means of proof of your order.
  • m. In a period of 168h to 96h prior to the completion of the package trip, confirm to the Client via e-mail and / or through the section "my reservation" in the website www.flykube.com to which of the possible destinations will travel the Beneficiaries and on what weekend, as well as the details of the flights, instructions for the check-in (if necessary) e information about the accommodation.

TRUTHFULNESS OF THE DATA PROVIDED BY THE CUSTOMER

The customer agrees that the data provided to us, directly through of our website or by calling Customer Service, be true, accurate and complete, and in particular that the credit or debit cards you use are from their ownership and that there are sufficient funds to cover the cost of the product / service that wants to hire

NEW WORLD SOLUTIONS, S.L. reserves the right to cancel the client's reservation in case of non-payment, return of collection, or in case of false data or that can not be verify the data of the customer's card.

Likewise, NEW WORLD SOLUTIONS, S.L. is not responsible for a possible denial of shipment or other cases derived from the erroneous data entered by the Client.

SECOND: CONDITIONS OF USE AND RESPONSIBILITY

2.1 The FlyKube service sent to the Beneficiary gives the right to a service provision of transport, provided by the operator corresponding to the selected FlyKube flight, as well as accommodation in the selected establishment.

2.2 The performance of the service is subject to the specific conditions of the operator of the selected flight, especially the general terms and conditions of transport. It is therefore the Beneficiary's responsibility to inform the chosen collaborator about the existence of possible specific conditions (such as boarding schedules, luggage restrictions, etc.). Any rejection by a Collaborator to perform the benefit for the reasons previously cited will not be considered as discrimination of any kind or as a breach, and shall not involve any responsibility on the part of NEW WORLD SOLUTIONS, S.L. or of the Operator involved. Is Customer's responsibility to ensure that Beneficiaries have the documentation necessary to travel to the possible destinations, as well as passport, visas, etc.

2.3 The Beneficiary is responsible for printing the boarding pass that NEW WORLD SOLUTIONS, S.L. will send to your email, or download from the "my booking "of the Web, or online check-in on the website of the flight operator selected, if necessary. NEW WORLD SOLUTIONS, S.L. will not be responsible of Operator surcharges derived from billing and boarding processes, such such as the non-printing of the boarding pass, excess baggage, etc.

2.4 NEW WORLD SOLUTIONS, S.L., is limited to carrying out the work of intermediation between the user and the Operator, without promising or making any provision, so it will only be responsible for its activity, in accordance with the law, excluding the enforceability of responsibility for the breach of the services contracted between the user and the service provider or Operator

2.5 Operators and collaborators selected by NEW WORLD SOLUTIONS, S.L. are holders of professional liability insurance for notorious amounts sufficient and possess all the authorizations or diplomas that allow them to exercise their activities (operating licenses and air operator certificates).

2.6 NEW WORLD SOLUTIONS, S.L. reserves the right to terminate its relations with one or more Operators and collaborators during the validity period of the FlyKube in particular in view of ensuring an optimum level of quality of benefits.

2.7 NEW WORLD SOLUTIONS, S.L. will not be responsible for the breaches caused by force majeure or fortuitous event, whatever the nature of these.

2.8 NEW WORLD SOLUTIONS, S.L. is not responsible for delays or cancellations of flights. In case a flight changes its schedule or is canceled we can help initiate a claim to the Collaborating airline, although it is the Customer who must demand your rights directly to the company.

2.9 NEW WORLD SOLUTIONS, S.L., in order to operate, you need to assign the data. If said assignment involves the identification of specific natural persons, this constitutes a communication of personal data, defined in article 3.i) of the Organic Law 15/1999, as "any disclosure of data made to a person other than the interested party". THIRD: PRICE AND CONDITIONS OF PAYMENT

3.1 The prices of each FlyKube are those that appear on the Web at the moment when the customer place the order. In accordance with the applicable legislation, the price of FlyKube includes the price of the flight with included airport taxes, accommodation, management expense and its corresponding VAT.

The additional expenses that may arise from the contracting of services not offered in the most basic fee of the selected FlyKube operator are not included in the price of the FlyKube.

The fees or supplements applied by the operators or collaborators, particularly those Tourist accommodation rates are also not included in the FlyKube price.

3.2 The payment of the order can only be made with a bank card (Visa Card, Eurocard or Mastercard) indicating in the section provided for that purpose the card number and its validity date, as well as its control code located on the back of the card. The totality The amount of the order will be deducted from the bank card on the day of the order. NEW WORLD SOLUTIONS, S.L reserves the right to suspend the processing of the order in case of rejection of the payment authorization by the bank. FOURTH: RIGHT OF WITHDRAWAL

Once the payment of your FlyKube is made, the Customer will not be entitled to any refund no modification of dates or data of the passengers of your reservation.

Under article 103 section l) of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defense of Consumers and Users and other complementary laws, the right will not be applicable of withdrawal to contracts that refer to the provision of accommodation services for purposes other than serving as housing, transportation of goods, rental of vehicles, food or services related to recreational activities, if the contracts provide for a specific date or period of execution.

Regarding the transport of people, according to article 93 k) of the Royal Legislative Decree 1/2007 approving the Consolidated Text of the General Law for the Defense of the Consumers and Users the regulation of distance sales with the exception of the article 98.2) does not apply to passenger transport service contracts. SEVENTH: VALIDITY OF THE CONTRACT

In case of not completing an order, the client may receive emails about the company.

NINTH: APPLICABLE LEGISLATION

These General Conditions of Sale and the contract concluded on the occasion of a FlyKube order will be governed by Spanish law, so the litigious issues that could arise on the interpretation and application of the same will be resolved, by the Courts and Tribunals of Barcelona capital.

TENTH: RESPONSIBILITY OF THE ORGANIZERS AND DETAILS

Under article 162 section l) of Royal Legislative Decree 1/2007, of 16 November, which approves the revised text of the General Law for the Defense of Consumers and Users

  • 5. No exceptions may be established by means of a contractual clause as provided for in Sections 1 and 2 of this article.
